The Board of Directors of the South San Joaquin Irrigation District met in regular session in their chambers at the hour of 9:00 a.m. 

 

Upon roll call the following members were noted present:

 

DIRECTORS:         HOLBROOK         KAMPER        KUIL        SCHULZ         ROOS

 

Also present were Secretary/Manager Shields, District Counsel Emrick, Communications Coordinator Saylor, Water Treatment Plant Manager Hubkey, Engineering Department Supervisor Bologna and District Engineer Gilton. 

 

President Kuil called the meeting to order and asked for public comment.  There being none he introduced Paul Voortman, of the Farm Bureau to the Board members, Mr. Voortman said he was just here as an interested citizen.  President Kuil asked the Board to consider approving the Consent Calendar Items as presented. 

 

CONSENT CALENDAR

 

A.                 Approving District Warrants of $259,632.07.

B.                 Approving Regular Board Meeting Minutes of January 8, 2008.

 

Motion by Director Holbrook, seconded by Director Schulz, to approve the Consent Calendar Items as presented.  

 

PASSED AND ADOPTED this 22nd day of January 2008 by the following roll call vote:

            Noes:          None

 

President Kuil asked Hubkey to give his report:

 

Hubkey is happy to report that the frequency of PG&E Electrical outages is down. 

 

New employee, Jimmie Perry, will be starting January 28, 2008 as an Operator. 

 

Overaa is currently doing warranty work at the plant.

 

During the windstorm earlier this month several lights on the log booms were lost.  There was no damage to the booms.

 

Reported Shields and Emrick will be me eting with Zenon/General Electric tomorrow January 23rd, relative to problems with the fibers. 

 

Shields said Black & Veatch has prepared a power point presentation for that me eting, which is to be held in their Concord offices.  He said he feels this presentation should demonstrate there is a problem and expects to get a positive reception. 

 

Hubkey said so far in January 2008 we have spent approximately $17,000 on fiber repairs. Director Roos asked if older plants have this type of problem.  Hubkey said no but the old plants do not remove 100% of bacteria.  Gilton said our plant is one of the biggest fiber plants, and the larger design may be part of the cause.  However, the fibers we use remove not only bacteria, but 100% of Cryptosporidium and Giardia. 

 

Director Holbrook said that caulking should not have been used in 100% wet conditions.  Hubkey said he would look into this. 

 

Shields said we have two Operators in Training positions to be filled.  Mid Valley Utility Association is offering training February 6, and 7, 2008 for those interested in applying for those positions.  We notified all our employees of the training and hope so me will take advantage of it. 

 

Consider purchasing four ½ ton pickups.  Shields said we received bids from three dealers.  Steves Chevrolet, $22,038.24; A me rican Chevrolet, $22,118.89; and Chase Chevrolet $23,353.17.  He recom me nds purchasing from Steves Chevrolet.  Motion by Director Schulz, seconded by Director Roos, and unanimously carried, to approve the purchase of the four ½ ton pickups from Steves Chevrolet at a cost of $22,038.24 each.  Price includes sales tax and all delivery costs and fees. 

 

Consider purchasing a 1 ton cab & chassis and service body for the welder to replace the 1999 1 ton.  Shields said we have only one bid on the truck body from Stiles Truck Body at $14,902.  We have three bids on the 1 ton and they are including the truck body:   Steves Chevrolet $37,633.33; A me rican Chevrolet $38,848.62; and Chase Chevrolet $39,198.55.  He recom me nds the low bid, Steves Chevrolet $22,731.34. Motion by Director Kamper, seconded by director Holbrook, and unanimously carried, to purchase the 1 ton truck from Steves at $22,731.34, and the truck body from Stiles Truck Body for $14,902.00 for a total price of $33,633.33.  Price includes sales tax and all delivery cost and fees.  

 

Consider purchasing a new 2 axle dump truck with bed to replace our 1993 International.  Shields said we received three bids, all included the 1993 trade in.  He said we either replace this unit or spend $14,000 to me et air quality standards.  The bids are:   Interstate International Truck Center $63,011.85; Com me rcial Truck Company $64,112; and Valley Peterbilt $68,724.  Recom me ndation is that we accept Interstate International at $63,011.85, which is net after the trade of the 1993; trade in was $11,877.   Motion by Director Roos, seconded by Director Kamper, to purchase the 2 axle truck from Interstate International Truck Center at $74,888.85 less trade in of $11,877 for a net cost of $63,011.85. Price includes sales tax and all delivery costs and fees.  Motion Carried, Ayes 4, Noes 1, with Director Schulz voting No.  

 

 Consider purchasing a Diesel 4 X 4 Extended Cab Pickup for the Water Superintendent.  Three dealer submitted bids.  A me rican Chevrolet $33,589.85; Steves Chevrolet $33599.81; and Chase $35,227.63.  All include sales tax.  Shields recom me nds purchasing from A me rican Chevrolet, the low bidder.  After discussion it was moved by Director Holbrook, seconded  by director Kamper, to purchase the vehicle from A me rican Chevrolet, at total cost of $33,589.85 including sales tax and all delivery costs and fees. Motion Carried, Ayes 4, Noes 1 with Director Kuil voting No. 

 

Consider approving Agreement with San Joaquin County for the replacement of the McBride Avenue Bridge at the Main Canal and authorize staff to approve plans when completed.  Bologna said the County is ready to proceed; they are trying to secure funds, but need our approval first. Director Roos asked how much water flow is there in the canal.  Bologna said they plan to design a diversion for 300 cfs and will need to pump the rest which could be as much as 500 cfs. It is hard to say if that will be sufficient. The culvert will be designed to handle 900 cfs. Director Holbrook pointed out some errors in the legal descriptions in the documents.  Bologna noted them and said he will correct the errors. Bologna recommended authorizing signature of the document entitled “Amendment to Consent to Common Use Agreement”.  Additionally authorize staff to sign the plans when they are satisfactorily completed. Motion by Director Schulz, seconded by Director Holbrook, and unanimously carried, to approve as recommended. 

 

President Kuil asked for General Manager’s report:

 

Shields thanked the Board me mbers for supporting the employee recognition dinner last Friday and for their participation in the event. 

 

Relative to Director Roos’ concerns about Ripon draining into our facilities. Staff found four spots where they are, or may be, draining.  He said he intends to contact the City of Ripon and negotiate a drainage agree me nt as have Manteca and Escalon. 

 

Discussed Prop 13 funds and the possibility the State could take them.  Stein said the State of California took in 1992/1993 fiscal year under the Educational Revenue Aug me ntation Fund (ERAF) $257,892 of approximately $1,500,000 due that year.  The State is still taking that, with increases annually based on today’s market values,.  To date they have taken approximately $7,000,000 from SSJID .  In fiscal year 2004,/2005 & 2005/2006 they took $1,000,000 each year.  None of this has ever been repaid to the District, and likely never will be. Director Schulz pointed out that in 1993 we actually assessed growers to make up this difference. In 2005 Prop 1A was passed by the voters which basically says the State can borrow our funds twice per decade, but only after paying back the amount previously borrowed, plus interest, can the State borrow a second ti me .  Hopefully the State will not be able to rescind Prop 1A.

Directors’ reports:

 

Director Kamper talked about a pipe to Ripon Christian for irrigation.  Said Sam Bologna and I have been looking at possible alternatives.

 

Director Holbrook said the City of Stockton is going to give a tour of their belt filter press next week.  Anyone wanting to attend should contact him. 

 

President Kuil called for closed session.  District Counsel Emrick said we will be discussing items a, c, and d in closed session. 

 

a)                  Conference with legal counsel, existing litigation, Government Code Section 54956.9.  One case.

b)                  Conference with legal counsel, anticipated litigation, significant exposure to litigation, Government Code Section 54956.9.  One case.

c)                  Conference with labor negotiator.  Agency negotiators:  Lee Clark & Jeff Shields .  Employee organization:  I.B.E.W., Local 1245.

d)                  Public employment–Government Code Section 54957. Title: Utility Systems Director.        

 

Upon returning from closed session District Counsel Emrick reported the following action was taken in closed session:

 

Motion by Director Kamper, seconded by Director Roos, and unanimously carried to Appoint Don Battles as the Utility Systems Director as a part-ti me , at will contract employee.  A contract will be prepared.

 

The Board then considered approval of the job description for the Utility System Coordinator.  It was moved by Director Holbrook, seconded by Director Kamper, and unanimously carried, to approve the revised job description for the Utility Systems Director. 

 

There being no further business to come before the Board it was moved by Director Schulz, seconded by Director Kamper, and unanimously carried to adjourn to February 12, 2008 at 9:00 a.m.
